U.S. EPA Proposes Redesignation of Three Indiana Counties to Attainment for Ozone Standard

By Andy Bowman, Chair, Environmental Law Department, Bingham McHale LLP

On April 9, 2007, U.S. EPA announced it is proposing to approve requests by the State of Indiana to redesignate LaPorte, St. Joseph and Elkhart Counties from nonattainment to attainment for the eight-hour ozone air quality standard. Monitoring data collected during 2003-2006 met the eight-hour ozone standard. Once the proposed redesignation is published in the Federal Register, the public will have 30 days to submit comments. Upon final approval of the attainment designations, new and existing sources in these counties will no longer be subject to the stricter emission offset requirements of the new source review permitting rules.
