U.S. EPA Proposes Redesignation of Nine Central Indiana Counties to Attainment for Ozone Standard

By Andy Bowman, Chair, Environmental Law Department, Bingham McHale LLP

On July 31, 2007, U.S. EPA announced that it is proposing to redesignate Boone, Hamilton, Hendricks, Johnson, Madison, Marion, Morgan and Shelby counties to attainment for the eight-hour ozone standard. U.S. EPA is also proposing to approve the ozone maintenance plan and motor vehicle emission budgets submitted by the Indiana Department of Environmental Management. 72 Fed. Reg. 41658 (July 31, 2007). Monitoring data collected during 2004-2006 met the eight-hour ozone standard. The U.S. EPA is taking comments from the public until August 30, 2007. Upon approval of the attainment redesignation, new and existing sources in these counties will no longer be subject to the stricter emission offset requirements of the new source review rules.
