Appellate

In some cases the outcome of litigation is unacceptable. When stakes are at their highest and an appeal is the only alternative, you should consult with experienced appellate attorneys. Bingham McHale is one of the most respected and effective appellate groups in Indiana. Our responsive appellate group is unique in two respects. 

First, unlike other firms, our core members spend a majority of their time handling civil appeals. They have been involved in hundreds of appellate cases involving a wide spectrum of legal disciplines.

Second, our firm offers a depth of experience that is second to none. Our members include a former Indiana Supreme Court Administrator, a former Chair of the Supreme Court Rules Committee, a former Chair of the Appellate Section of the Indiana State Bar Association, and two of only four lawyers in Indiana recognized as members of the American Academy of Appellate Lawyers.

Our team members receive appellate referrals from all over Indiana, from small, single-issue appeals to multimillion dollar verdicts involving lengthy trials and multiple complex issues.

  • Interlocutory appeals;
  • Direct appeals to the Indiana Supreme Court;
  • Writs of mandamus or prohibition (original actions);
  • Review and preparation of jury instructions;
  • Review and preparation of dispositive motions or response; and
  • Post-judgment proceedings, including
    • Motions to correct error or motions for relief from judgment,
    • Advice on preserving issues at trial,
    • Petitions for Certiorari to the United States Supreme Court, and
    • Appellate mediation.
