Litigation
Bingham McHale handles complex proceedings throughout the state
of Indiana. We effectively represent institutional and individual
trustees, personal representatives, guardians, beneficiaries of
trusts and probate estates, prospective adoptive parents and other
contested probate and trust matters. We litigate claims involving
breach of fiduciary duty for and against fiduciaries and their
agents; removal of fiduciaries; will and trust interpretation;
construction and reformation; charitable gifts; prudent investor
duties; attorney and fiduciary fee disputes; and disputed claims
for and against estates, trusts and guardianships. We handle most
types of will and trust contests including claims of undue execution,
lack of capacity, fraud, duress and undue influence, omitted spouses
and beneficiaries and related challenges.
We also prosecute claims for creditors against probate and trust
estates and are experienced in attorney and accounting malpractice
cases related to trust and estate administration and tax issues
including complicated generation skipping tax matters.
