and economic pressures constantly impact the health care industry.

Bingham McHale routinely responds to the legal needs of health
insurers, provider entities, hospitals, nursing facilities, assisted
living facilities, physician groups and other health care-related
entities. Our litigators effectively assist in contractual, commercial
and real estate disputes; employment and labor issues, administrative
matters and various other health care-related disputes. Our experience
includes pre-litigation, pleadings, discovery, dispositive motions,
alternative dispute resolution, trial and appeals.
We regularly represent health care insurers relating to health
claims disputes including issues related to coverage, payment,
exclusions, medical necessity, rescission, pre-existing conditions,
individual and group policy termination. Our attorneys have handled
arbitrations for our health care clients under the AAA rules and
private arbitrations.
The firm also has represented one of the largest HMOs in the state,
which included a variety of services such as defending member coverage
claims to lobbying the Indiana legislature. Specifically, the firm
represented that client in arbitrations for claims relating to
coverage for experimental medical treatments and medical necessity.
The firm handled coverage claims/arbitration and lawsuits, as well
as contractual type claims by providers, including hospitals and
physician groups.
