Professional Liability

Bingham McHale has substantial experience in effectively defending the interests of professionals including attorneys, accountants, securities broker-dealers and other licensed professionals.

Attorneys. One of the highest compliments we can receive is when first-rate lawyers retain us to represent them. We have been privileged to represent some of the largest law firms in the region, in cooperation with the Attorneys’ Liability Assurance Society, as well as a number of small to mid-sized firms, in disputes ranging from un-filed claims of malpractice to securities fraud and RICO litigation. We also routinely represent attorneys in proceedings before the Indiana Supreme Court Disciplinary Commission.

Accountants. The advent of Sarbanes-Oxley and enhanced scrutiny of corporate financial reporting has increased the risks faced by accounting firms that provide audit services. Lawyers representing such firms need to understand the workings of Financial Accounting Standards, GAAP and GAAS, and to know the accountant’s varying levels of responsibility when in engaged in an audit, as distinguished from a review or compilation of financial data. Bingham McHale has litigated a variety of issues and claims on behalf of national and regional accounting firms.

Securities Broker-Dealers. From customer complaints of churning or unsuitability, to disputes among brokerage houses over the solicitation of customers or registered agents, to the defense of investigations or subpoenas brought by the Indiana Securities Commissioner or by the NASD or NYSE (now FINRA), it is important to have Indiana counsel who can effectively handle the dispute or issue. The perceptive attorneys at Bingham McHale have experience representing securities broker-dealers who do business in Indiana. We know the regulatory procedures, and have arbitrated and litigated a variety of claims on behalf of broker-dealers.
